ARTFACE Fineart Ltd., (hereinafter “ARTFACE Fineart Ltd.”, “ARTFACE” or “we/us”) operates a platform and service for buying, selling, renting or lending works of art among various registered users (hereinafter “ARTFACE” or “ARTFACE service”) under the domain ww.artface.com.

In order to perform the ARTFACE service and to provide you (the “User”) the best user experience, your data will be collected, processed and used in accordance with the EU-General Data Protection Regulation (GDPR) 2016/679 of April 27th 2016 and the related privacy laws.

This privacy policy defines and clarifies how your personal data is being handled. Personal data is individual information regarding personal or factual circumstances of a specific or identifiable individual. This may include, for example but without limitation, name, date of birth, telephone number, email address and usage data, such as the IP address. 1. How will your data be collected, processed and used upon visiting ARTFACE with or without user account?

ARTFACE Fineart Ltd. uses the personal data that the user provides or that incurred in the use of ARTFACE for the implementation of the user relationship and as presented in this privacy policy.

Upon visiting the ARTFACE domain (to a so-called “landing page” or “homepage”), ARTFACE Fineart Ltd. collects the following data transmitted by the user’s device/browser:

2. How is your data collected, processed and used after registration of a user profile and upon use of ARTFACE services?

ARTFACE Fineart Ltd. uses the personal data that the user communicates or that becomes available when using ARTFACE after creating a user profile, solely for the implementation of the user relationship and as presented in this privacy policy. For such use, your additional consent is not required. The creation of a user profile is necessary to be able to use ARTFACE to its full extent and you herewith agree to this. In addition, you may provide further personal data, which ARTFACE Fineart Ltd. may use in order to provide the respective service and the best user experience.

2.1 Mandatory details for the creation of a user profile

For the creation of a user profile, the following details are essential and shall be provided:

  • Gender
  • First and last name
  • Address (Street, ZIP code, City, Country)
  • Phone number
  • Email
  • Password

The data provided by you will be collected, processed and used for the purpose of using ARTFACE. Without limitation these details serve for the mandatory data like personal address and authentication. They may also be used in connection with and for advertising purposes (see item 3).

2.2 Voluntary data

In addition you can add various voluntary details to your user profile. This serves, in particular, for communication between the user and ARTFACE (eg. Invoicing). These details may be provided by you optional and can be viewed, entered, modified or deleted by you at any time in the profile under Details.

2.3 IP addresses

User IP addresses are recorded for security and testing purposes. This should prevent any misuse of the service. The data is processed and used to prevent and combat illegal activities and spam as well as securing the integrity and stability of the ARTFACE platform.

2.4 Payment data

Subscriptions be charged by external payment providers. No payment data is collected or processed by ARTFACE Fineart Ltd. for any of such purchases. The entry as well as the processing of the payment data is solely by the payment provider. Technical data (the transaction ID and other) is being exchanged between ARTFACE Fineart Ltd. and the chosen payment provider in order to validate the purchase.

3. What cookies, tracking providers, analytical services does ARTFACE use? How are Social Media and Like buttons embedded?

3.1 Cookies and cookie policy

In order to make use of the ARTFACE domain as convenient as possible, we use ARTFACE domain cookies. Cookies are small text files, which are stored locally in the web browser temporary memory (so-called session cookies) or on the hard drive of the mobile device or computer in use (so-called permanent cookies). The browser settings can be selected by you to reject certain use of cookies or to be notified before setting cookies. The user is not attributed with identifiable IDs upon setting of cookies. Session cookies will be deleted from the temporary memory after closing of the browser session.

ARTFACE Fineart Ltd. also uses cookies to improve the security of the ARTFACE domain, for example, to authenticate the user during a session, to avoid cross-site scripting or to prevent phishing and fraudulent activities, such as scamming.

Furthermore, tracking provider and analytics services (see also item 3.2 regarding use of tracking provider and analytics services), under contract from ARTFACE Fineart Ltd., may place cookies on the user’s device to collect usage data. This data can be collected while the user navigates the ARTFACE website.

The user can influence the setting of cookies. Most browsers have a settings option whereby the storage of cookies can be restricted or completely disabled. We remind you that the usability of ARTFACE and the user experience can be limited by disabling cookies.

3.2 Tracking providers, analytics services

ARTFACE carries out user tracking analytics in order to optimize the ARTFACE services and user experience. ARTFACE Fineart Ltd. implements analytical methods that enables us to analyze visits to the ARTFACE domain. Furthermore, third-party tracking tools are integrated to analyze the range of different advertising campaigns and marketing activities. Personal data can also be transmitted under use of third-party tools.

In addition to troubleshooting, the purpose of data processing is the optimization of ARTFACE in regards to user experience. With web analysis methods, ARTFACE also obtains statistics on visitor numbers and their temporal browsing of popular content as well as the duration of visits per click and page. When appropriate, it can be tracked whether a user profile was created subsequent to an advertising. The data is processed and used to prevent and combat fake profiles, unlawful activities and spam as well as to ensure the security of the ARTFACE platform. User data is transmitted to various third parties to carry out the analysis.

Google Analytics

ARTFACE uses “Google Analytics”, a service by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland (hereinafter: “Google”). ARTFACE Fineart Ltd. points out that for use with ARTFACE, Google Analytics has been extended with the IP masking function “_gat. _anonymizeIp”, to guarantee the recording of anonymized IP addresses.

The following information on the use of Google Analytics should be noted:

Google Analytics uses cookies that are stored on the device and enable an analysis of the use of ARTFACE. The ARTFACE usage information produced by the cookie is generally transmitted to a Google server in the USA for storage. However, since IP anonymization is active, the IP addresses of all uses in the EU and associated countries are shortened by Google prior to transmission to the USA. Under contract between ARTFACE Fineart Ltd. and Google, Google uses the information to evaluate the use of our services, to compile reports on activities and to provide the operator with further services.

The user has the option to opt out by clicking this link. Google Analytics data acquisition and storage can be revoked at any time with future effect. The user also has the option to install a browser plugin issued by Google. This is available for various browser versions and can be downloaded here. Plug-ins and Tools

Vimeo

Our website includes plugins of the Vimeo video portal by Vimeo, LLC, 555 West 18th Street, New York, New York 10011, USA. Each time you visit a site that offers one or more Vimeo video clips, a direct connection is established between your browser and a Vimeo server in the USA. Information about your visit and your IP address is stored there. By interacting with the Vimeo plugins (e.g. clicking the start button), this information is also transmitted to Vimeo and stored there.

4. How is data disclosed / transmitted?

ARTFACE Fineart Ltd. does not pass on users’ personal information to third parties, unless provided with the user’s consent, the transmission is prescribed by law or permitted by law.

4.1 General information on the transmission of personal data

ARTFACE is permitted to transmit customer data to the following third parties for the execution of the agreement:

External service providers and representatives. ARTFACE can employ external companies or individuals to process customer data. Affiliated companies. ARTFACE can employ affiliated companies to process customer data.

ARTFACE is permitted to transmit and disclose customer data as follows:

5. What is the procedure for deleting data and creating backups?

All of the data collected from a user will be deleted upon deletion of the user profile (caution: not by just expiration of a subscription). This excludes data that must be retained due to legal regulations or the performance of the user agreement. Furthermore you can delete selected data in the profile at any time or make an appropriate request to us. Deletion of data from the productive databases and subsequently from the ARTFACE interface will be executed within 48 hours.

ARTFACE Fineart Ltd. reserves the right to check profile files before deletion and, if necessary, to secure them if, due to certain facts, there is a suspicion in the usage profiles that they are using ARTFACE in contradiction to the law or the user agreement. This serves to protect users of the ARTFACE services.

In addition to deletion of data triggered by the user, ARTFACE automatically deletes historical data that is no longer needed for the fulfilment of the agreement (e.g. IP data) from time to time.

6. What data security measures does ARTFACE provide?

We are taking the trust of our users and the protection of your data very serious. ARTFACE Fineart Ltd. implements appropriate physical, technical and administrative procedures to protect the information collected by ARTFACE Fineart Ltd. in order to prevent unauthorized access or disclosure of user data, to preserve the integrity of the data and to ensure the appropriate usage of the data.

In order to provide optimized protection of user data, the ARTFACE domain are operated under encrypted SSL connection. This guarantees encrypted data transmission between the servers and the browser as well as between the servers and third party servers.

7. User rights: consent and revocation, disclosure, rectification, deletion, transmission.

7.1 Consent and revocation

When registering with ARTFACE, you agree to the collection, storage and processing of your data in accord with this privacy policy and in accord with the terms and conditions. This consent must be expressly declared by you when creating your profile. Your consent, as well as the entire process of the creation of a user profile, is recorded by ARTFACE.

7.2 Disclosure, rectification, deletion, transmission

In accordance with the applicable laws, you are entitled to receive full disclosure of your stored personal data as well as, if necessary, to a right of rectification and / or deletion or transmission of your privacy data.

We reserve the right to request appropriate information from you that helps us to identify you as the entitled person related to the user data.

8. Changes to the privacy policy

ARTFACE Fineart Ltd. reserves the right to update this privacy policy from time to time. The use of the user personal data is subject to respective updated version.
